... Respondents / Respondents This case is taken up for settlement before the National Lok Adalat. Both the parties are present. Mr.M. Pachaiyappan, learned counsel for the Appellant and Mr. J. Michael Visuvasam, learned counsel for the second respondent/ insurance company are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows: TERMS OF SETTLEMENT The Tribunal has awarded a sum of Rs.5,74,800/-, with interest at 7.5% per annum, from the date of petition till the date of realization. Aggrieved by the award of the Tribunal, the appellant/ claimant preferred
the present appeal. It is stated that the second respondent/ insurance company had already deposited the award amount with interest to the credit of M.C.O.P.No.1195 of 2018 on the file of the Motor Accident Claims Tribunal, III Judge, Court of Small Causes, Chennai - 104 and the claimant had withdrawn the same.
2. After due deliberation and consultation, both the parties have agreed to settle the award to a sum of Rs.4,50,000/- (Rupees Four Lakhs and Fifty Thousands Only) over and above the amount awarded by the Tribunal, as full quit compensation, inclusive of the interest.
3. Hence, the second respondent/ insurance company is directed to deposit the enhanced amount of Rs.4,50,000/- (Rupees Four Lakhs and Fifty Thousands Only), arrived today, within a period of six weeks from the date of receipt of a copy of this order, to the credit of M.C.O.P.No.1195 of 2018 on the file of the Motor Accident Claims Tribunal, III Judge, Court of Small Causes, Chennai - 104 and on such deposit, the appellant/ claimant is directed to withdraw the same.
5. The Tribunal is directed to transfer the above said award amount to the Bank account of the appellant/ claimant by way of NEFT / RTGS, on proper identification, in accordance with the terms of the award, without insisting on any formal permission petition.
