C.M.P.No.11961 of 2023 in C.M.A.SR.No.69872 of 2023 N.SESHASAYEE, J.

This petition is filed to condone the delay of 1232 days in filing the above C.M.A.

2.Though notice has been served, no one appeared on behalf of the first respondent.

3.Ms.C.Bhuvanasundari, the learned counsel entered appearance for the second respondent and submitted that the delay is enormous and it is not adequately explained.

4.In response, the learned counsel for the appellant submitted that the papers were misplaced and got mixed up with other papers, and hence the delay.

5.This Court is satisfied with the reason above stated. Hence, this petition stands allowed.

Anu 6.It is underscored that in the eventuality of the appellant succeeding in the appeal to be taken on record, he would not be entitled to any interest for 1232 days.

7.The Registry is directed to print the name of the learned counsel for the second respondent in the cause list when the matter is listed for admission, and number the above C.M.A.SR.No.69872 of 2023, if the papers are otherwise in order.
