ORDER

This Transfer Civil Miscellaneous Petition has been to withdraw the proceedings in HMOP.No.5516 of 2023 from the file of the Principal Family Court, Chennai and transfer the same to the Family Court, Tiruvannamalai.

2.Pursuant to the directions of this Court, the parties are present today along with their respective counsel. The parties also confirmed that the balance amount, agreed to be paid to the petitioner by the respondent, has also been paid in full quits. The parties have no objection for final order being passed, dissolving the marriage between them. 3.This Court, in Tr.CMP.No.1328 of 2024, exercising powers under Article 227 of Constitution of India, transferred the pending HMOP proceedings to the file of the Sub Court, Arakkonam and converting the same under Section 13-B proceedings, proceeded to dissolve the marriage, by mutual consent.

4.I have personally enquired with the petitioner as well as the respondent. They have confirmed that they have no objection that a decree for dissolution of marriage may be passed by mutual consent. The maintenance amount that has been agreed between the parties is also paid in full and final settlement. Therefore, following the procedure adopted by this Court in Tr.CMP.No.1328 of 2024 dated 20.12.2024, HMOP.No.5516 of 2/4

2023 on the file of the Principal Family Court, Chennai, which has already been transferred by this Court, by earlier orders passed in the above transfer petition is taken up as one under Section 13-B of the Hindu Marriage Act and the marriage between the petitioner and the respondent dated 03.11.2019 stands dissolved by mutual consent, with no mutual claims between the parties.

5.With the above observation, the Transfer Civil Miscellaneous Petition is disposed of. There shall be no order as to costs. Connected Civil Miscellaneous Petition is closed.
