Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the condition in para 6(b) (ie. "the petitioners shall report the respondent police daily at 10.30 a.m., until further orders") imposed in Crl.O.P.No.12287/2021 dated 16/07/2021. Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.R.JAYAPRATHAP, Advocate for the Petitioners and of MR. A.GOPINATH, Govt. Advocate ( Crl. Side) on behalf of the Respondent the court made the following order:- (The case has been heard through video conference) This Criminal miscellaneous petition has been filed by the petitioners to modify the condition in Paragraph No.6 clause (b) "the petitioners shall report the respondent police daily at 10.30 a.m until further orders" imposed in Crl.O.P.No.12287/2021 dated 16.07.2021.
2. This Court by its order dated 16.07.2021 in Crl.O.P.No.12287 of 2021 imposed the aforesaid condition to the petitioners. However, the petitioners have complied with the condition. Thereafter, the https://hcservices.ecourts.gov.in/hcservices/
present modification petition has been filed to modify to the effect that the petitioners shall appear before the Jurisdictional Court instead of respondent police.
3. Considering the facts and circumstances of the case and the petitioners are facing two previous cases, and also the submissions of the learned counsel for the petitioners that there was previous enmity between the respondent police and the petitioners, the petitioners have made a complaint to the Superintendent of Police as against the respondent officials. If the aforesaid condition is modified, there will be no progress in the investigation. Therefore, this modification petition is liable to be dismissed.
4. Accordingly, this Criminal Miscellaneous Petition is dismissed.
