..Respondent(s) Prayer: Writ Petition is filed under Article 224 of the Constitution of India praying for issuance of writ of Mandamus directing the respondents to redetermine and pay enhanced compensation to the petitioner at the rate of Rs.500/- per sq.ft., based on the application dated 03.03.2026 submitted by the petitioner under S.28(2) of the Land Acquisition Act 1894 in respect of the land in R.S.No.239/12 situated at Oulgaret Revenue Village, Puducherry acquired under the same Section 4(1) Notification on par with similarly placed adjacent landowners, in the light of the judgments of this Honble Court in A.S. Nos. 249 and 250 of 2018 and A.S.Nos.17 18 and 19 of 2024 together with all statutory benefits and interest as per the Land Acquisition Act, 1894 and consequently direct the respondents to disburse the said enhanced compensation to the petitioner.

Mr.V.Vasanthakumar, Additional Government Pleader (Pondicherry) Order This Writ Petition has been filed to direct the respondents to re-determine and pay enhanced compensation to the petitioner at the rate of Rs.500/- on par with similarly placed adjacent landowners.

Learned counsel for the petitioner submitted that the petitioner is the absolute owner of the land situated in R.S.No.239/12, measuring an extent of 16,416 sq.ft, Oulgaret Revenue Village, Puducherry. The said land was acquired by the Deputy Collector (Revenue) North-cum-Land Acquisition Officer, Puducherry, for the purpose of construction of a cricket stadium. The petitioner was awarded compensation at the rate of Rs.75/- per sq.ft. However, it is alleged by the petitioner that in respect of adjacent landowners, whose lands were acquired under the same notification, this Court vide Appeal Suit Nos.249 and 250 of 2018, dated 17.10.2023, enhanced the compensation to Rs.500/- per sq.ft. Since, the petitioner is also entitled to the same enhanced compensation, he submitted earlier two representations and the last representation/application dated 03.03.2026 to the 2nd respondent, seeking re-determination of compensation. Since the said representation was not considered, the petitioner is before this Court.

3. In reply, the learned Additional Government Pleader (Pondicherry) appearing for the respondents would submit that the petitioners' representation dated 03.03.2026 will be disposed of by the respondents within a period of twelve weeks.

4. Heard the learned counsel for the petitioners and the learned Additional Government Pleader for the respondent and also perused the materials available on record.

In view of the above, this Court directs the 2nd respondent to consider the petitioners' representation dated 03.03.2026 and dispose of the same by taking into consideration the law laid down by the Hon'ble Apex Court in the case of Narendra and others Vs. State of U.P. And others reported in (2017) 9 SCC 426, within a period of twelve weeks from the date of receipt of copy of this order.
