ORDER

(This case has been heard through video conference) This Criminal Original Petition has been filed seeking a direction directing the 2nd respondent not to harass the petitioner by appreciating the facts and circumstances of the case.

2. The petitioner, on the complaint of one Deepa, is being unnecessarily called for enquiry and harassed. The https://hcservices.ecourts.gov.in/hcservices/

petitioner and the said Deepa are neighbouring landowners and they have some dispute over the boundary of the property, which is purely civil in nature.

3. The learned Government Advocate (Crl. side) appearing for the respondents would submit that the defacto complainant Deepa, who is adjacent landowner of the petitioner, has lodged a complaint and the petitioner was called for enquiry. During enquiry, the petitioner agreed to take steps to measure, survey land and demarcate the boundaries. If any excess land is available, which does not belong to the petitioner and the same will be handed over to his neighbour, if there is sufficient proof of documents.

4. I have considered the submissions made on either side and perused the materials available on records carefully.

5. With the above undertaking, the petition enquiry was closed on 16.09.2020. In view of the closure of complaint, nothing survives. Hence, this Criminal Original Petition is closed.
