These two Civil Miscellaneous Petitions have been filed seeking to condone the delay of 96 days in re-presenting the papers which had been returned by the Registry for compliances.

2.Heard learned counsel appearing on behalf of the petitioner. 3.It appears that pending an application filed seeking to recall the order passed in the Second Appeal, some of the appellants had died and consequential applications had been filed, but which had been returned by the Registry. It had been contended that there was a delay in representation. 4.In the affidavit filed in support of the petition, it had been stated that papers which had been returned by the Registry had been misplaced in the office of the counsel and there was a delay in retrieving and identifying them.

smv 5.In view of the above reasons stated the delay is condoned and these Civil Miscellaneous Petitions are allowed.

6.The Registry may examine the other applications filed and number them and also put them up for consideration on 20.07.2022. The learned counsel for the appellants may serve the relevant records to the learned counsel for the respondents.
