ORDER

The petitioner has approached this Court seeking a direction to the respondent to hand over his vehicle, viz. mini door van, bearing Reg No.TN 10 J 0227, which was seized by the respondent/Police in connection with a false complaint lodged by one S.M.Duraiarasan, Chennai Corporation Ward Councilor, due to previous enmity.

2. Learned Government Advocate appearing for the respondent submitted that the petitioner has not assigned any valid reason in the affidavit for the return of the vehicle seized by the respondent/ Inspector, Virugambakkam Police Station.

3. Hence, taking note of the said submission and as there is no valid reason for seizure of the vehicle, this Court is of the view that if the petitioner's vehicle is available with the respondent/Police, then the respondent shall return the same to the petitioner within 15 days from the date of receipt of a copy of this order.

The Writ Petition is disposed of with the above direction. No costs. Consequently, connected W.P.M.P.No.37078 of 2004 is closed.
