Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 4th and 5th respondents to transfer the investigation in Crime No.3 of 2024 on the file of the 5th respondent and the cases against the MY V3 ADS on the file of the 5th respondent to the Central Bureau of Investigation (CBI) herein or any other competent investigating agency for fair and proper investigation.

The Writ Petition is filed to transfer the investigation in Crime No.3 of 2024 from the 4th and 5th respondents to Central Bureau of Investigation.

2. The Learned Counsel for the petitioner submitted that the scheme of money circulation under the banned MY V3 ADS been promoted by the accused persons and several crores of rupees been cheated from the gullible public. The complaint by these two petitioners for cheating a sum of 2/5

Rs.1,21,00,000/- from each of them been registered but no action taken so far. Meanwhile, the accused persons are continuing to cheat the public through MY V3 ADS scheme.

3. The Learned Government Advocate (Crl.Side) for the respondents states that pursuant to the complaint received, one of the accused was arrested and released on bail but since spate of complaint been received, the investigation is transferred to Economic Offences Wing, Chennai on 04.06.2024 and taken on file in Crime No.9 of 2024.

4. On instruction, the Learned Government Advocate (Crl.Side) for the respondents submits that the Deputy Superintendent of Police who is investigating the case will take necessary steps to secure the accused persons and also will take measures to prevent further collection of money by deceit.

5. Recording the above undertaking, this Writ Petition is disposed of. No costs. Consequently, connected Miscellaneous Petitions are closed. 14.06.2024 3/5
