Mr.P.Harish, learned Government Advocate accepts notice for R1 and R2 and Mr.R.Kishore Kumar, learned Government Advocate (Crl. Side) accepts notice for R3 and R4. No notice is issued to R5 to R9 as this order takes note of their interests and duly addresses the same as well.
2. Instructions have been received by the learned counsel appearing for the official respondents and this would enable the final disposal of this matter, even at this juncture. All learned counsel express their consent for disposal of this matter, even at the stage of admission.
3. The petitioner seeks a mandamus directing the respondents to consider her representation dated 17.05.2024, wherein, she has sought action to be initiated against the private respondents in respect of drawing of water from the Well situated at S.No.210/2, Panaimadal Village, Attur Taluk, Salem District. 2 / 4
4. The entirety of the prayer is premised on various factual assertions and this Court does not find the need to advert in light of the fact that the representation of the petitioner is admittedly pending. This is confirmed by Mr.Harish, learned counsel for R2, who is the appropriate authority to consider the same.
5. Hence, mandamus is issued to R2, Tahsildar, Attur Taluk, Salem District to issue notice to the petitioner as well as to the private respondents, hear them, conduct an enquiry with any other persons, who may deemed necessary, including the official respondents and dispose the petitioner's representation dated 17.05.2024 within a period of eight (8) weeks from date of receipt of a copy of this order, in accordance with law and all applicable Rules and Regulations.
6. This Writ Petition is disposed as above. No costs. Connected Miscellaneous Petition is closed.
