This application has been filed seeking to incorporate a paragraph in plaint as paragraph 20-A bringing on record the factum of death of the defendants 2 and 9 and also make a statement that their legal representatives need not be impleaded since the suit is not filed against them in their individual capacity.

2. Considering the nature of amendment and the absence of prejudice to the respondents, this application is allowed as prayed for.

3. The learned counsel for the plaintiff to carryout amendment and file an amended copy of the plaint.
