O R D E R

The grievance of the writ petitioner is that 50% of the services rendered by the petitioner as part-time vocational instructor is to be counted for reckoning the qualifying service for grant of pension.

2. Rule 11(4) of the Tamil Nadu Pension Rules was amended and accordingly, 50% of the temporary services shall be taken for the purpose of reckoning the qualifying services if the conditions stipulated in the rules are complied with. However, the Hon'ble Full Bench of this Court while interpreting the rules, has clarified that part-time services cannot be counted for the purpose of reckoning the qualifying services under Rule 11(4) of the Tamil Nadu Pension Rules.

3. In the present case, the petitioner was working as parttime vocational instructor and therefore, such part-time services cannot be taken into consideration for the purpose of reckoning the qualifying service. Thus, the petitioner is not entitled for the relief as such sought for in the present writ petition.

Accordingly, this Writ Petition is dismissed. No costs. Consequently, the connected miscellaneous petition is closed. Sd/- Assistant Registrar(CO) //True Copy// Sub Assistant Registrar gm To
