This Civil Miscellaneous Petition has been filed seeking to condone the delay of 20 days in filing the above Cross Objections against the award dated 27.07.2022 passed in M.C.O.P.No. 503 of 2019, on the file of Motor Accident Claims Tribunal, I Addl. District Judge, Tindivanam.
2. Mr.A.Ramalingam, learned counsel for Cross Objectors submitted that the 1st respondent insurance company preferred appeal as against the award passed by the tribunal in the above and the same was admitted by this court on 12.12.2022, but as on date no notice served on the cross objectors. He would submit that for abandoned cause, they have preferred this cross objection and filed the above petition during month of June 2024, however, there is a delay of 20 days in filing the above Cross Objections arose, which is neither willful nor wanton. Therefore, he filed this petition to condone the delay in filing the above Cross Objections.
3. Mr.S.Arunkumar, learned counsel for 1st respondent appeared and raised strong objections stating that the delay was not properly explained.
4. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit is justifiable one, this court is inclined to allow this petition. Registry is directed to number the Cross Objections if it is otherwise found to be in order. The interest for the delay period is ordered to be waived.
