This application has been filed by the applicant/second defendant to condone the delay of 42 days in filing the written statement, because he could not file the written statement within 30 days and he could file the written statement after 30 days, however, within 120 days. 2.The learned counsel for the respondents have also no objection to allow this application.

3.Though the reasons stated in the accompanying affidavit is not satisfied, in order to give an opportunity to the applicant/second defendant to defend their case, this Court is inclined to allow this application.

4. Accordingly, this application is allowed and the delay is condoned.
