These petitions have been filed seeking to condone the delay of 677 days in filing petition to set aside abatement, consequent to the death of the sole appellant, to set aside abatement and to bring on record the legal representatives of the deceased appellant / Santha Ammal, as appellants 2 to 5. 2.In the affidavit filed in support of these petitions, it had been contended that the sole appellant, Santha Ammal, had died on 27.11.2021. It had been stated that owing serious family problems, the petitioners could not meet the counsel to inform about the death of the appellant. Thereafter, they met the counsel and informed the fact and then, these petitions have been filed. 3.In view of the fact that the legal representatives of the sole appellant have a right to prosecute the appeal further, we would condone the delay and allow these petitions.

4.The Registry is directed to carry out necessary amendment in the cause title to the appeal suit.
