This petition has been filed to call for the records relating to FIR in Cr.No.183 of 2018, on the file of the respondent police and quash the same.
2. On the complaint lodged by Usha, the respondent police have registered a case in Cr.No.183 of 2018 on 13.03.2018 under Sections 294(b), 323, 447 and 506(ii) IPC and Section 3(1) of the Tamil Nadu Public Property (Prevention of Damage and Loss) Act, for quashing which, the accused have filed the present petition.
3. Learned counsel for the petitioners/accused submitted that the petitioners are related to the de facto complainant and the de facto complainant has given a false complaint. However, on a reading of the complaint, it is seen that, the de facto https://hcservices.ecourts.gov.in/hcservices/
complainant has specifically alleged that on 05.03.2018, the accused came to her land and damaged the water pump and also physically assaulted her. Thus, when there are prima facie materials for the investigation to proceed, the same cannot be quashed at the threshold.
