This Writ petition has been filed under Article 226 of the Constitution of India to issue a Writ of Mandamus or any other appropriate writ or order or direction in the nature of writ directing the respondent to consider and pass orders on the representation dated 24.02.2013 regarding to sanction family pension with effect from 09.09.2007 and other terminal benefits, after regularizing the two spells of suspension undergone by the petitioner's husband, as treat as duty as per Fundamental Rule 54B(2) and Rule 9 of under Fundamental Rule 54, respectively within the stipulated time as fixed by this court. O R D E R

This petition has been filed for direction to the respondent to consider the representation dated 24.02.2013 regarding to sanction family pension with effect from 09.09.2007 and other terminal benefits, after regularizing the two spells of suspension undergone by the petitioner's husband, as treat as duty as per Rule 54B(2) and Rule 9 of Fundamental Rule, respectively within the stipulated time as fixed by this court.

2. The learned counsel appearing for the petitioner submitted that, pending writ petition, the respondent had issued a proceedings dated 14.01.2020 in Na.Ka.No.63/2020/A1 and thereby ordered that the suspension period of the individual from 05.07.2005 till 01.08.2006 is treated as duty period. The above said proceedings dated 14.01.2020 has also been placed before this court.

3. Recording the above said submission and the afore said proceedings dated 14.01.2020, this court directed the respondent to sanction the terminal benefits of the deceased (petitioner's husband) in accordance with the order dated 14.01.2020, as early as possible, and to pay the same to the petitioner.

4. Accordingly, this writ petition is disposed of. No costs. Consequently, connected writ miscellaneous petition is closed.
