CORAM:

THE HON'BLE MR. JUSTICE SATISH K. AGNIHOTRI and THE HON'BLE MR. JUSTICE M. VENUGOPAL W.P. No.34826 of 2015 Kandapalli Pavan ..Petitioner Vs.

The Deputy Collector (Revenue-cum-Regional Administrator) Yanam Puducherry The Deputy Tahsildar (Revenue) Yanam Puducherry ..Respondents Writ Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus directing the second respondent to issue the petitioner MBC (origin) caste certificate forthwith pursuant to his application dated 07.10.2015. For Petitioner :Mr. V.V. Sairam For Respondents:Mr. M. Govindaraj Government Pleader (Puducherry)

ORDER

(delivered by SATISH K. AGNIHOTRI, J.) Mr.M.Govindaraj, learned Government Pleader (Puducherry), accepts notice for the respondents. With consent, the writ petition is taken up for final disposal, at the admission stage itself.

The petitioner seeks consideration of his application dated 07 October 2015 made to the second respondent, whereunder, he has sought Most Backward Class (for brevity "OBC") social status certificate.

Incontrovertibly, the respondent Government, by notification dated 19 February 2001, has notified Rajaka Chakkali as OBC. The petitioner now claims Rajaka social status certificate.

The petitioner has also obtained Nativity Certificate dated 09 October 2015, wherein, it is found that he has been residing at Kothapeta, Yanam, continuously for five years preceding the date of the said certificate. It is also not disputed that the petitioner is a resident of Yanam before issuance of the aforestated notification.

In such view of the matter, there cannot be any difficulty for the authorities in considering the petitioner's application in the light of the notification dated 19 February 2001, notifying various communities as OBCs.

Thus, the respondents are directed to consider the petitioner's application as early as possible, preferably within a period of four weeks, on its own merits and in accordance with law and pass appropriate order.

The writ petition stands disposed of with the aforestated direction. Costs made easy.
