Prayer:- Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure to direct the respondents to provide police protection to the petitioner in enforcing the order of interim injunction passed by the learned District Munsif, Walajapet, in I.A.No.26 of 2015 in O.S.No.79 of 2013 and help the petitioner to enjoy fee and unobstructed access to the common passage.

ORDER

This Criminal Original Petition has been filed seeking a direction to the respondents to provide police protection to the petitioner in enforcing the order of interim injunction passed by the learned District Munsif, Walajapet, in I.A.No.26 of 2015 in O.S.No.79 of 2013 and help the petitioner to enjoy free and unobstructed access to the common passage.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public prosecutor appearing for the respondents.

It is seen that the petitioner has filed a suit in O.S.No.79 of 2013 before the District Munsif Court, Walajapet and in I.A.No.26 of 2015, already, he has obtained an order of Police Protection on 30.01.2015. Thereafter, it is not known as to what is the further order that has been passed by the Civil Court.

4.Under such circumstances, liberty is given to the petitioner to give a representation to the second respondent and on such representation being given, the second respondent is directed to call both the parties for enquiry and during the enquiry, if it is found that the order of Civil Court granting police protection subsists, it is needless to state that the second respondent police shall give police protection as directed by the learned District Munsif Judicial Magistrate No.II, Walajapet in I.A.No.26 of 2015 in O.S.No.79 of 2013. In view of the above, the criminal original petition is closed.
