(Crime No.28 of 2021) PRAYER : This Criminal Original Petition is filed under Section 439(1)(B) of CRPC to modify the condition imposed on the petitioner by the learned Principal District and Sessions Judge, Coimbatore by an order dated 01.07.2021 made in Crl.M.P.No.2417 of 2021 "(iv).The petitioner is directed to sign before the respondent police station daily at 10.00 a.m., until further orders after relaxation of the lockdown period". ORDER

This Criminal Original Petition has been filed by the petitioner to modify the condition imposed on the petitioner by the learned Principal District and Sessions Judge, Coimbatore by an order dated 01.07.2021 made in Crl.M.P.No.2417 of 2021 " (iv)The petitioner is directed to sign before the respondent police station daily at 10.00 a.m., until further orders after relaxation of the lockdown period".

2. The learned counsel for the petitioner submits that the petitioner is a Chronic Kidney disease patient and he had also sustained fractures and he is unable to comply with the condition. Hence, he prays to modify the said condition.

3. The learned Government Advocate (Crl.Side) submits that he has no objection to modify the said condition. https://hcservices.ecourts.gov.in/hcservices/

4. Accordingly, clause (iv) appearing in Paragraph No.4 of order dated 01.07.2021 in Crl.M.P.No.2417 shall stand modified as under:

(iv) The petitioner is directed to appear before the respondent police on every Monday at 10.30 a.m till completion of the investigation. And thereafter, as and when required.

This Criminal Original Petition is allowed in the aforesaid terms. Time is extended by a further period of two weeks from the date of receipt of a copy of this order for executing sureties. Except for the above modification all other conditions imposed vide order dated 01.07.2021 shall stand unaltered.
