Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus to call for the records relating to the tender notice published in Daily Thanthi dated 18.09.2007 issued by the respondent for maintenance of super structure for Vermin Composting on BOT manner and work of door to door garbage collection from specified areas of the Wellington Cantonment and to transport the garbage to the designated area (Trenching Ground) and quash the same and consequently direct the respondent herein to accept the petitioner's bid submitted pursuant to the tender notice published in Daily Thanthi dated 24.06.2007.

Today, when the matter is taken, the learned counsel appearing for the petitioner submitted that the prayer in the writ petition has become infructuous and to that effect, he has also made an endorsement.

2. Further, the learned counsel for the petitioner submitted that that the petitioner participated in the tender process after depositing the EMD. However, the learned counsel appearing for the respondent fairly conceded that the EMD is not refunded.

3. Recording the endorsement made by the learned counsel appearing for the petitioner, this writ petition is dismissed as infructuous.
