(Order of the Court was made by S.S.SUNDAR, J.) This writ miscellaneous petition is filed to implead the petitioner herein as party respondent in the writ petition.

2. According to the petitioner, he is the absolute owner in respect of one of the properties in the layout and a resident of the area. The writ petition has been filed by the writ petitioner challenging the order passed by the local body cancelling the planning permission given earlier to the writ petitioner, on the ground that there is a dispute with regard to the property which was purchased by the writ petitioner. Even though there are civil proceedings which ended in favour of the writ petitioner, this petition to implead is filed by a person, who is a party in the earlier proceedings.

3. In such circumstances, having regard to the facts stated in the affidavit filed in support of the petition, this petition is ordered and the Page No.1/3

petitioner herein is impleaded as the fifth respondent in the writ petition.

4. Post the writ petition on 16.02.2024 for filing of counter affidavit(s) by the respondents.
