ORDER

This contempt petition is filed alleging violation of the order dated 07.09.2017 passed in W.P.No.12775 of 2012 & batch. 2.

This Court, ordered notice and in response to the same, 1/3

Mr.A.Tamilvanan, learned Additional Government Pleader (Pondicherry) appeared for the respondent and brought to the notice of this Court that the order dated 07.09.2017 passed in W.P.No.12775 of 2012 & batch was set aside by the learned Division Bench of this Court in W.A.Nos.69 to 72 & 74 of 2019. The said appeals were allowed by the learned Division Bench by an order dated 16.06.2023 setting aside the order dated 07.09.2017 passed in W.P.No.12775 of 2012 & batch. However, it is contended by the learned counsel for the petitioner that the said appeal were only filed against the direction that was issued by the learned Single Judge insofar as regularization of services of the petitioner herein is concerned, but not against the payment of arrears of salary.

This Court is unable to accept such contention as the order dated 07.09.2017 was set aside by the learned Division Bench in its entirety, the question of order of the learned Single Judge being in operation partly does not arise.
