Respondents Prayer: Writ Petition has been filed under Article 226 of the Constitution of India seeking a Writ of Mandamus directing the 3rd respondent to refund the amount of Rs.35,000/- with interest at the rate of 18% per annum paid by the petitioner to the 3rd respondent vide Receipt No.4749, dated 15.05.2017, towards part payment for Tuition Fee for getting admission for his Son.U.Sathyanarayanan for the course of B.Com (Actuarian Management) for Academic year - 2017-2018, based on the representation dated 29.06.2017 and consequential legal notice dated 27.11.2017 issued by the petitioner.

This writ petition has been filed seeking refund of a sum of Rs.35,000/- towards payment of tuition fees from the third respondent.

2. The petitioner got admission in the third respondent college in B.Com course, he had also paid the first year fees immediately, thereafter, the petitioner got admission in another college and after getting his transfer certificate, joined some other course in another college. However, the third respondent college did not refund the tuition fees paid by the petitioner, hence the present writ petition has been filed.

3. Mr.Abrar Md.Abdullah, learned counsel appearing for the third respondent on instruction submitted that the third respondent college without prejudice to its rights, ready to refund a sum of Rs.35,000/- to the petitioner. The learned counsel also produced a Demand Draft bearing No.120352, dated 02.03.2022, drawn on Indian Bank, Peelamedu branch, for Rs.35,000/- and handed over the same to the learned counsel appearing for the petitioner. The learned counsel for the third respondent further submitted that the petitioner should not make any further claim against the third respondent. The learned counsel for the petitioner also agreed to the same and submitted that the petitioner is satisfied with the amount and he will not make any further claim as against the third respondent. Recording the said submission made by the learned counsel appearing for the petitioner, this writ petition is closed as no further adjudication is required in this matter. No costs.
