Mr.R.Premchander PRAYER: Civil Miscellaneous Petition is filed under Section 151 of the Civil Procedure Code, to grant time for complying with the conditional order dated 03.03.2026 passed in C.M.P.No.4321 of 2026 in C.M.A.SR.No.173901 of 2025.

O R D E R

This Civil Miscellaneous Petition has been filed seeking extension of time to comply with the order passed by this Court in C.M.P.No.4321 of 2026 in C.M.A.SR.No.173901 of 2025.

The petition in C.M.P.No.4321 of 2026 in C.M.A.SR.No.173901 of 2025 was filed seeking to condone the delay of 648 days in filed the appeal.

The said petition was allowed by this Court on 03.03.2026, subject to the condition that the petitioner/Insurance Company shall pay costs of Rs.500/- to the Cancer Institute (WIA), Gandhi Nagar Canal Bank Road, Adyar, Chennai - 20, on or before 16.03.2026. It was further ordered that in the event of failure to pay the costs within the stipulated time frame, the petition shall stand automatically dismissed without any further reference to this Court.

The fact remains that the costs of Rs.500/- imposed by this Court have been paid by the petitioner/Insurance Company on 27.03.2026, which is, of course, after the time frame stipulated by this Court vide order dated 03.03.2026.

Now the present miscellaneous petition has been filed seeking to grant time for complying with the order dated 03.03.2026. 2/4

Now that the order dated 03.03.2026 has been complied with, though not within the time frame, the factum of payment of costs is recorded and no further orders are required to be passed in this petition. 7.
