ORDER

The petitioner apprehends arrest for the alleged offence under Sections 191(1), 296(b), 115(2), 118(1) and 351(2) of BNS Act, 2023 in Crime No.135 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The allegation against the petitioner is that, due to prior enmity arising

out of an earlier incident at a briyani shop, on 13.04.2026, the petitioner along with other accused attacked the defacto complainant and caused injuries using a beer bottle and a knife. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and has been falsely implicated in this case. He further submitted that he is ready to abide by any conditions that may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner has 13 previous cases to his credit, out of which 8 cases are NDPS Act, one under the TNP Act, apart from other IPC offences. Hence, he opposed to grant anticipatory bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side and also perused the records available.

6. Taking into consideration the circumstances of the case and the past conduct, this Court is able to visualise his character, Apart from that, this Court could able to see how the petitioner misused the liberty granted by this Court. Hence, the petitioner does not deserve anticipatory bail.
