Respondent Prayer :- Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus forbearing the respondent from dispossessing the petitioner from the petitioner's agriculture land having extent of 79 cents, comprised in survey No.33/34, indexed in patta No.499 and situated at Vaniyanthangal Village, Thiruvannamalai District. ORDER

This writ petition is filed for direction forbearing the respondent from dispossessing the petitioner from the petitioner's agriculture land having extent of 79 cents, comprised in survey No.33/34, indexed in patta No.499 and situated at Vaniyanthangal Village, Thiruvannamalai District.

2. Heard, Mr.P.G.Thiyagu, the learned counsel for the petitioner, and Mr.V.Jeevagiridharan, Additional Government Pleader appearing for the respondent.

3. On instruction, the learned Additional Government Pleader submitted that the subject land is a patta land owned by the petitioner and at any event, the petitioner will not be dispossessed from his patta land without following due process of law.

4. In view of the above, the respondent is directed not to dispossess the petitioner from the land having extent of 79 cents, comprised in survey No.33/34, indexed in patta No.499 and situated at Vaniyanthangal Village, Thiruvannamalai District without due process of law.

5. With the above direction, this writ petition is disposed of. Consequently, connected miscellaneous petition is closed. No order as to costs.
