The petitioner has filed this writ petition seeking issuance of Writ of Certiorarified Mandamus calling for the records relating to charge Memo in Na.Ka.No.441/A5/2022 dated 21.02.2025 issued by the first respondent and quash the same and to issue consequential directions to the respondents to take unbiased and appropriate decision upon the outcome of the criminal case on the merits of the case and in accordance with law.
2.The learned counsel appearing for the petitioner submitted that as against the impugned order, there is effective appeal remedy available to the petitioner before the Director of Elementary Education. Hence, this Court, without going into the merits of the case, may grant liberty to the petitioner to exhaust the appeal remedy and issue direction to the Director of Elementary Education to consider the same and pass appropriate orders within a reasonable time frame and further prayed that the period during which the writ petition was pending before this Court may be excluded for the purpose of limitation.

3.The learned Government Advocate appearing for the respondents raise no serious objection.
4.Considering the limited request now made by the learned counsel appearing for the petitioner, this Court, without expressing any opinion on the merits of the case, permits the petitioner to file appeal before the Director of Elementary Education, within a period of two weeks from the date of receipt of a copy of this order. If any such appeal is filed by the petitioner, the Director of Elementary Education shall consider the same, on merits and in accordance with law and pass appropriate orders, within a period of six weeks thereafter. The petitioner is at liberty to raise all the grounds before the Director of Elementary Education. The period during which the writ petition was pending before this Court is excluded for the purpose of limitation. 5.The writ petition is disposed of. No costs.
