ORDER

This petition has been filed to call for the records in C.C.No.16/2023 on the file of the learned Judicial Magistrate, Thirukoilur, Kallakurichi District and quash the same.

2. The final report is filed for the offences punishable under Sections 279, 337 & 304(A) of IPC and 199A of the Motor Vehicles Act, 1988. The petitioner is A2.

3. The very crux of the charge-sheet is that A2 had allowed A1 to drive the vehicle knowing that A1 did not have license to drive. A1 hit against two persons causing death. Prosecution has conducted investigation and filed its final report. The statement of the witnesses clearly indicate that A2 allowed A1 to drive the vehicle and the A2 did not have valid driving license which caused death of two persons.

4. Such view of the matter, this Court is of the view that it is not a fit case for quashment of charge-sheet. Accordingly, this petition stands dismissed. Consequently, connected miscellaneous petitions stand closed. 16.09.2025 dhk :Yes/No Internet : Yes/No 2/4
