( Criminal Jurisdiction ) Monday, the Twenty Third day of August Two Thousand Twenty One PRESENT The Hon`ble Mr Justice M.DHANDAPANI CRIMINAL MISCELLANEOUS PETITION No.8128 of 2021 IN CRL OP.10268/2021 K.AANDI [ PETITIONER/ACCUSED ] Vs THE STATE REP BY [ RESPONDENT ] THE INSPECTOR OF POLICE, NIB-CID POLICE STATION, VILLUPURAM DISTRICT CR NO. 12/2021 Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to relax the condition 5(e) the petitioner to appear before the respondent police daily at 10.30 a.m., until further order imposed by this Hon'ble Court in Crl.O.P.No.10268/2021 in Crime No. 12 of 2021 in pending investigation on the file of the respondent police and thus render justice.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.V.GUNASEKAR, Advocate for the Petitioner and of MR. A.GOPINATH, Govt. Advocate ( Crl. Side) on behalf of the Respondent the court made the following order:- Vide Order dated 23.06.2021, this Court had relaxed the condition and directed that the petitioner to appear before the respondent police daily at 10.30a.m., until further orders.

2. The present petition has been filed seeking modification of the said condition,

3. Learned Government Advocate (Crl.Side) appearing for the respondent, on instruction, submits that the petitioner has been complying with the conditions without fail.

4. In view of the above submission, this Court is of the considered view that the prayer as sought for by the petitioner could be acceded to.

5. Accordingly, the condition insofar as appearance as imposed by order dated 23.06.2021 alone stands modified that till filing of the charge sheet, the petitioner is directed to appear before the respondent police on every Monday at 10.30 a.m, and thereafter, the petitioner is directed to appear before the concerned court on each and every hearing dates at 10.30 a.m, until further orders. All other conditions remain unaltered.
