ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

2. The present writ petition is filed praying for a writ of mandamus, to direct the respondents to pass appropriate orders on the appeal petition dated 13.09.2024.

3. It is submitted by the learned counsel for the petitioner that the petitioner is the owner of the land comprised in Survey No.265/1A covering an extent of 1523 Sq. meter. It is further submitted by the learned counsel for the petitioner that the respondents had issued a notification whereby for developing NH844, many lands had been acquired by the respondents, out of which the 2/5

petitioner's land was also acquired for the formation of NH 844 respectively. For the same, the 2nd and 3rd respondents had valued the petitioner's land, awarded a sum of Rs.31,56,564/- as compensation for the land acquisition and the said amount was deposited in petitioner's bank account by award dated 24.06.2024. 3.1. It is further submitted by the learned counsel for the petitioner that in the said award, the land value had been fixed very low by the respondents without considering the present market value of the property. Aggrieved by the same the petitioner preferred an appeal before the 1st respondent on 13.09.2024. However, the petitioner's appeal dated 13.09.2024 has been kept pending by the respondents till date, thus the present writ petition has been filed before this Court.

The learned Special Government Pleader appearing for respondent 1 and 2 would submit that the petitioner's appeal dated 13.09.2024 would be disposed of within a time frame to be fixed by this Court, to which the learned counsel for the 3rd respondent does not have any objection and agreed to by the learned counsel for the petitioner.

5. In view there of, the writ petition stands disposed of with a direction to the respondents to dispose of the petitioner's appeal dated 13.09.2024 within a 3/5

period of 16 weeks from the date of receipt of copy of this order after affording the petitioner and any other interested parties a reasonable opportunity of hearing. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the matter on its own merits and in accordance with law.
