ORDER

This application has been filed to appoint a sole arbitrator to decide the dispute and differences between the petitioner and the respondent.

The learned counsel for the petitioner is intending to settle the dispute with the respondent and that out of the total amount of RS.95,00,000/-, the petitioner has paid Rs.30,00,000/- lakhs. The petitioner requires two more months time to pay the remaining amount to the respondent.

In the light of the above undertaking given by the petitioner, this application is closed for the present. If the settlement does not go through, it is left open to the parties to revive the application under Section 11 of the Act, seeking for appointment of an arbitrator. No costs.
