Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a writ of Mandamus to direct the respondent to pay the petitioner the difference/arrears of wages for the period from 01.09.2016 to 31.04.2017 and also terminal benefits namely Gratuity and Encashment of Leave, as admitted by the Respondent in the RTI information dated 14.03.2025, after having revised the same based on the scale of pay payable to him on the month of his retirement, together with 18% interest per annum, within a time frame as may be fixed by this Court. ORDER
The present writ petition has been filed to pay the petitioner the difference/arrears of wages for the period from 01.09.2016 to 31.04.2017 and also terminal benefits namely Gratuity and Encashment of Leave, as admitted by the Respondent in the RTI information dated 14.03.2025, after having revised the same based on the scale of pay payable to him on the month of his retirement, together with 18% interest per annum, within a fixed time frame.
2. The learned counsel for the petitioner would submit that the petitioner is claiming the difference in arrears of wages and for terminal benefits. The representation has been given by the petitioner on 17.03.2025 and such representation is yet to be considered by the respondent.
3. The learned counsel appearing for the respondent would submit that they will consider the petitioner's representation, within a reasonable time.
4. In view of the above submission, without going into the merits of the writ petition, this Court deems it appropriate to direct the respondent to 2/4
consider the petitioner's above representation and pass order, within a period of six (6) weeks from the date of receipt of a copy of this order, according to its own merits and in accordance with law.
5. With the above direction, the writ petition stands disposed of. No costs.
