C.M.P.No. 11172 of 2022 in C.R.P. No. 2227 of 2019 T.V. THAMILSELVI, J.

This Civil Miscellaneous Petition has been filed seeking to set aside the order dated 13.06.2022 dismissing the above Civil Revision Petition for non-prosecution.

2. Mr.J.Chandran Sundar Sashikumar, learned counsel for revision petitioner submitted that the petitioner's counsel was affected with Covid-19, he was under home quarantine, due to which he could not attend the hearing of this case on that day. Accordingly, it was dismissed for nonprosecution. Hence, he filed the above petition to restore the C.R.P. and prayed to allow this petition.

4. Ms.R.Poornima, learned counsel appearing for respondent appeared and she has raised strong objections for allowing this petition.

5. Considering the facts and circumstances, and being satisfied with the reasons assigned in the affidavit filed in support of the petition, this Court is inclined to allow this petition and to restore the Civil Revision Petition.

6. Post the matter on 08.11.2022 finally.
