PRAYER:

Criminal Original Petition filed under Section 482 of the Cr.P.C., praying to direct the first respondent police to transfer the investigation of the FIR pending in Crime No.45 of 2018 on the file of the Sub Inspector of Police, Kaladipet Police Station, Puducherry to the file of the Inspector of Police, CBCID Police for proper and speedy investigation and deal with the same according to law.

O R D E R

This petition has been filed seeking for transfer of investigation in Crime No.45 of 2018 on the file of the second respondent.

2. The petitioner has given a complaint to the second respondent on 07.07.2018 to the effect that the petitioner and

his family had gone away to attend a funeral and when they returned back home, they found that the door was broken open and the entire house was ransacked and valuable jewelleries and cash had been stolen away from the house. The FIR was registered in Crime No.45 of 2018 on 07.07.2018. Since there was no progress in the investigation, the present petition has been filed seeking for transfer of investigation.

3. The learned counsel for the petitioner submitted that the entire savings of the petitioner was taken away by the persons who have broken open the door and taken away all the valuables. The learned counsel submitted that for the last one year, there has been no progress in the investigation and the respondent police have not even interrogated one suspect in this case.

4. The learned Public Prosecutor, Puducherry, on instructions submitted that the incident has taken place on 03.07.2018 and the complaint was given on 07.07.2018. In the course of investigation, the Investigating Officer has visited the scene of crime and has prepared the rough sketch and also has taken the finger prints from the scene of crime. He would further submit that four suspects were already interrogated by the respondent police and it was found that they were not involved in this case. The learned counsel further submitted that the investigation is in progress and effective steps are being taken to nab the culprits and recover the stolen articles.

5. Taking into consideration the facts and circumstances of the case, there shall be a direction to the Superintendent of Police (West) to monitor the investigation conducted by the second respondent. The second respondent shall continue with the investigation effectively and shall take all efforts to nab the culprits and recover the stolen articles and file the final report as expeditiously as possible.

6. This Criminal Original Petition is disposed of with the above direction.
