BY ITS, [ RESPONDENT ] INSPECTOR OF POLICE, SIVAGIRI POLICE STATION, ERODE DISTRICT. CR.NO.228 OF 2012.

Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition passed by this Honourable Court in Crl.M.P.No.1 of 2015 in Crl.R.C.No.1137/2015 dated 29.10.2015.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.R.KARTHIKEYAN, Advocate for the petitioner and of MR. C.IYYAPPARAJ,Govt.Advocate (Crl. Side) on behalf of the Respondent the court made the following order:- This petition has been filed to relax the condition imposed by this Court by order dated 29.10.2015 in Crl.M.P. No.1 of 2015 in Crl.R.C.No.1137 of 2015.

2. This Court by order dated 29.10.2015, while granting the order to suspend the sentence of imprisonment against the petitioner, has imposed the condition that the petitioner shall appear before the trial Court on the first working day of every month at 10.00 a.m. pending disposal of the revision.

3. Mr.R.Karthikeyan, learned counsel for the petitioner submits that from the month of January 2016, the petitioner has been complying the said condition every month without fail. Therefore, he seeks the relaxation of the said condition.

4. Mr.C.Iyyapparaj, learned Additional Public Prosecutor, on instructions, would submit that the petitioner from 04.01.2016 onwards has been continuously complying the condition by appearing before the Court concerned on first working day of every month till last month without fail. In view of the said fact that the petitioner had been complying the condition scrupulously for the past more than 1-1⁄2 years this Court is inclined to relax the said condition.

5. Accordingly, the condition imposed by order dated 29.10.2015 of this Court that, the petitioner shall appear before the trial Court on the first working day of every month at 10.00 a.m. pending disposal of the revision, is hereby relaxed.
