This case came up for settlement before the Lok Adalat. Mrs.C.Bhuvanasundari, learned counsel for the Appellant, Mrs.P.Uma learned counsel for the respondents 1 to 5 and there was no appearance for the respondents 6 to 8 and Mr.G.B.Saravanabhavan, Area Manager (Legal) for Reliance General Insurance Company Limited are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:
TERMS OF SETTLEMENT The Tribunal has awarded a sum of Rs.8,10,200/- with interest at 7.5% per annum from the date of filing of the petition i.e. 21.12.2010 till the date of deposit with cost. Aggrieved by the award of the Tribunal, the appellant / Insurance Company had preferred the present appeal. The appellant / Insurance company official reported that they had already deposited a sum of Rs.7,37,169/- before the Tribunal.
2. After due deliberation and consultation, both the parties have agreed to modify the award to a sum of Rs.13,00,000/- (Rupees Thirteen Lakhs only) in full quit, including the awarded amount already deposited a sum Rs.7,37,169/- before the Tribunal.
3. In view of considering the fact that the Insurance company has already deposited a sum of Rs.7,37,169/- before the Tribunal. In addition to that the Insurance company is directed to deposit the modified balance amount of Rs.6,07,169, within a period of six weeks from the date of receipt of a copy of this order.
4. On such deposit, the claimants are permitted to withdraw their modified award amount of Rs.13,00,000/- in full quit, along with accrued interest if any, in the same ratio as apportioned by the Tribunal, without filing any formal petition. Award is passed accordingly.
5. The Tribunal is directed to transfer the amount through RTGS/NEFT to the party concerned on proper identification in accordance with the terms of the award, without insisting on any formal permission petition.
6. The Civil Miscellaneous Appeal is disposed of accordingly. Consequently, the connected Miscellaneous Petition is closed.
