COMMON ORDER Challenging the impugned order dated 17-04-2026 passed in IA.Nos.7 & 8 of 2026 in COS.No.66 of 2024, on the file of the Principal Commercial Court at Egmore, Chennai, the defendant has preferred these revision petitions.
2. Before the trial court, the defendant has filed an applications to recall PW1 for further cross examination, which was dismissed by the trial judge by holding that to fill up lacuna such applications cannot be entertained by relying the ratio laid down in Vadiraj Naggappa Varnekar (D) Th. Lrs Vs Shard Chand Prabhakar Gogate reported in (2009) 4 SCC 410 . Aggrieved over the same, the defendant has preferred these revision petitions.
3. The learned counsel for the revision petitioner submits that at the time of filing the applications on the side of the plaintiff new documents were adduced. To that effect, he want detailed fact, but the court below failed to give such opportunity. Aggrieved over the same, the defendant has preferred these revision petitions.
4. Considering the fact that now the trial has commenced, PW1 was already cross examined and the defendant filed applications to recall PW1 which was not entertained. The learned counsel submits that some of the
documents which was adduced in respect of each individuals, he wants to make legal defence. Considering the fact that the dispute is pending between the parties, one more opportunity can be given to the defendant and the findings of the trial court is set aside.
5. Accordingly, these Civil Revision Petitions are allowed. The impugned order dated 17-04-2026 passed in IA.Nos.7 & 8 of 2026 in COS.No.66 of 2024, on the file of the Principal Commercial Court at Egmore, Chennai, are set aside. No costs.
