Criminal Original Petition filed under Section 438 of Cr.P.C., to enlarge the petitioner on bail in the event of his arrest in Connection with the Crime No.1368 of 2020 pending on the file of the respondent police.

ORDER
(This case has been heard through video conference) The petitioner who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 294 (b), 332, 506(2), 307 of IPC r/w. 4 (1) (a) of TN Prohibition Act in Crime No.1368 of 2020, on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner was illegally selling liquor and when it was questioned by the Sub Inspector of Police, the petitioner assaulted him with iron rod at shoulder, as a result of which, he sustained injuries. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that A2 and A3 were arrested and enlarged on bail. Therefore, he prays for grant of anticipatory bail to the petitioner.
4. The learned Additional Public Prosecutor would submit that the injured has been discharged from the hospital. He would further submit that there are five previous cases as against the petitioner. Hence, he opposed for grant of anticipatory bail to the petitioners.
5. Taking into consideration the facts and submissions of the learned Counsel and also the fact that the petitioner has five previous cases, this Court is not inclined to grant anticipatory bail to the petitioner.
6. Accordingly, this Criminal Original Petition is dismissed.
