This petition is filed under Article 226 of The Constitution of India praying to issue a writ of mandamus directing the second respondent to issue a patta in the name of the petitioner for the property belonging to the petitioner's father comprised in Survey Nos.9, 12, 53/1, Sirupakkam Village, Veppur Taluk (previously Tittakudi Taluk), Cuddalore District, measuring about 5 acres of agricultural land along with 5 cents of residential plot by considering the representation of the petitioner dated 23.12.2014.

ORDER

Heard Mr.K.Premnaath, the learned counsel for the petitioner and Mr.V.Subbiah, learned Special Government Pleader, who accepts notice on behalf of the respondents and with the consent of either side, the writ petition itself is taken up for final disposal at the admission stage.

The petitioner has filed this writ petition seeking for issuance of a writ of mandamus to consider his application for grant of patta, which now stands in the name of his father, by including not only the petitioner's name and the names of the other two legal heirs also. Since the petitioner's application is still pending and no orders have been passed on the same, the https://hcservices.ecourts.gov.in/hcservices/

petitioner is before this Court.

3. It is note worthy to mention at this juncture that the Government, vide G.O.Ms.No.99 dated 21.9.2015 has issued a revised procedure to the effect that any grievance petition received through online and offline of Government Offices, have to be dealt with in a particular manner. The directions issued by the Government provides a time frame, following which such applications shall be considered. The aforesaid Government Order was taken note of by the Honourable First Bench of this Court in W.P.No.25887 of 2015, dated 6.10.2015 and the Government offices were directed to enforce the same and also give adequate publicity of the Government Order through online.

In the light of the above, there will be a direction to the second respondent to consider the petitioner's representation dated 23.12.2014 and pass orders on merits and in accordance with law, after affording an opportunity of personal hearing to the legal heirs of the deceased patadars, within a period of six months from the date of receipt of a copy of this order.

The writ petition is disposed of accordingly. No costs.
