ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

2. The present writ petition is filed praying for a writ of mandamus to direct the 3rd respondent to consider and dispose the petitioner's representation dated 14.10.2024 for issuance of patta.

It is submitted by the learned counsel for the petitioner that the petitioner is in possession and enjoyment of the land comprised in Survey No.251/1 measuring an extent of 34 cents situated at Vadathorasalur Village. It is submitted that the petitioner along with his father is cultivating vegetables and other agricultural produce in the said land.

3.1. It is submitted by the learned counsel for the petitioner that the petitioner had submitted a representation seeking issuance of patta for the said property to the District Collector on 10.12.2008 and 16.12.2008 and the same was forwarded to the 3rd respondent with a direction to conduct enquiry. However, no enquiry has been conducted nor patta has been issued. It is further submitted that the petitioner again submitted a representation on 14.10.2024 to the 3rd respondent for issuance of patta and the same was forwarded to Firka 2/5

Surveyor by the 3rd respondent vide proceedings No.A3/44/2024 with a direction to conduct survey. However no action has been taken to issue patta in the name of the petitioner. Aggrieved by the same the present writ petition has been filed before this Court.

4. The learned Government Advocate appearing for the respondents would submit that the petitioner ought to have taken out an online application for issuance of patta.

5. When this was pointed out, the learned counsel for the petitioner would submit that they may be permitted to take out an online application for issuance of Patta in respect of Survey No.251/1, measuring 34 cents.

6. The learned Government Advocate would submit that if any such application is made the same would be considered and appropriate orders would be passed, which was agreed to by the learned counsel for the petitioner.

7. In view thereof, the petitioner is at liberty to take out an online application for issuance of patta with respect to the property comprised in Survey No.251/1. If any such application if filed the respondents shall consider 3/5

the same, if it is otherwise in order and pass appropriate orders in accordance with law.
