ORDER

This petition has been filed to direct the 2nd respondent to register an FIR on the complaint dated 14.05.2016 given by the petitioner against the respondents 3 to 5.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the State. https://hcservices.ecourts.gov.in/hcservices/

3. Learned Additional Public Prosecutor submits that petition enquiry is pending before the second respondent and that the petitioner is not co-operating with the enquiry.

4. Hence, the petitioner is directed to co-operate with the enquiry and the second respondent Police is directed to conduct enquiry and during the course of enquiry, if any cognizable offence is made out, a regular case shall be registered, following the decision laid down by the Hon'ble Supreme Court in Lalita Kumari Vs. Government of Uttarpradesh and Others reported in (2014) 2 SCC 1, otherwise the petition may be closed under intimation to the petitioner.

With the above direction, this criminal original petition is closed.
