Respondents PRAYER: Writ Petitions filed under Article 226 of the Constitution of India, for issuance of writ of Certiorarified Mandamus, calling for the records of the second respondent herein in punishment order No.013340/ivy;5/mtpnghf/2024 dated 09.04.2024 and quash the same and consequently direct the second respondent to regularize the period of suspension of the petitioner herein from 26.07.2022 to 03.01.2024 as duty as per proviso of model standing order 17(4) and pay the wages to him.

ORDER

The petitioner, who is working as Driver-cum-Conductor, is imposed with the punishment of increment cut for a period of three years with cumulative effect by the order dated 09.04.2024. As against the said order, the petitioner has filed an appeal on 07.05.2024 on the file of the third respondent and the same is pending.

2. Since the appeal, which is preferred as per the Rules, is pending before the third respondent, this writ petition is disposed of on the following terms:

(i) the third respondent is directed to consider the appeal filed by the petitioner dated 07.05.2024, on its own merits and in accordance with law, and pass final orders thereon as expeditiously as possible, in any event not later than a period of eight weeks from the date of a receipt of a copy of this order.

There shall be no order as to costs. Consequently, W.M.P.No.16405 of 2024 is closed.
