This petition has been filed to transfer the investigation in Crime No.529 of 2023 pending from the file of the second respondent to any other independent investigating agency.
2. Heard the learned counsel for both sides and perused the materials placed on record.
3. On perusal of the records, it reveals that the petitioner is the wife of the deceased, viz., Amarnath. Her husband committed suicide on 15.11.2023 with a suicidal note, and it reveals that particular persons are responsible for his suicide. Even then, the second respondent registered the First Information Report under Section 174 of Cr.P.C in Crime No.529 of 2023. Thereafter, the First Information Report was closed as "further action dropped." Aggrieved by the same, the petitioner filed a protest petition, and after a specific direction issued by the learned Judicial Magistrate No.II, Walajapet in Crl.M.P.No.47 of 2025, the second respondent proceeded with further investigation. Therefore, the petitioner could not get a fair 2/5
investigation at the hands of the second respondent. Therefore, this Court is inclined to transfer the investigation from the file of the second respondent to the file of the Inspector of Police, District Crime Branch, Ranipet.
4. In view of the above, the second respondent shall hand over the entire case diary in Crime No.529 of 2023 to the Inspector of Police, District Crime Branch, Ranipet forthwith. On receipt of the same, the Inspector of Police, District Crime Branch, Ranipet is directed to complete the investigation and file a final report within a period of three months from the receipt of the entire case diary.
