ORDER

The learned counsel for the petitioner circulated a letter, dated 23.10.2025 to the Registry stating that he received instructions from the petitioner to withdraw the Civil Revision Petition, on the ground that the main suit itself has been settled. He has also made an endorsement to that effect.

2. The learned counsel for the third respondent would submit that the third respondent has filed an application to re-call the compromise, recorded in the collateral proceedings, namely CMA arising out of the dismissal of petition for appointment of receiver in the original suit.

3. Recording the submission made by the learned counsel for the petitioner as well as the respondent and also the endorsement made by the learned counsel for the petitioner, this civil revision petition is dismissed as withdrawn. Connected miscellaneous petition is closed. There shall be no order as to costs. The third respondent is entitled to prosecute the above said re-call

application filed in collateral proceedings.
