The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 379 and 430 of IPC in Cr. No.166 of 2022 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner is alleged to have transported three bags of sand which contains one unit of river sand illegally. Hence, the complaint.
3.The learned counsel appearing for the petitioners would submit that the petitioner is an innocent person and he has been falsely implicated in this case and he has not committed any such offence. Hence, he prays to grant anticipatory bail to the petitioner.
4. The learned Additional Public Prosecutor would submit that that the quantity of sand involved is one unit of river sand. He further
submitted that there is four previous cases pending against the petitioner. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.
5. Considering the facts of the case and the submissions made by the learned Additional Public Prosecutor that the petitioner has four previous cases pending against him, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original petition is dismissed.
