Petition praying that in the circumstances stated therein the High Court will be pleased to (i) Interim suspend the sentence imposed by judgment dated 25/02/2019 in Special Sessions Case No.17 of 2017 on the file of the Magalir Neethimandram, (Fast Track Mahila Court), Tiruvallur and release the Petitioner on PETITION FOR BAIL Under Sec. 439 Cr.P.C. pending disposal of the above Crl.A.No.384 of 2019. Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.R.SASIKUMAR, Advocate for the petitioner and of MS.R.MUNIYAPPARAJ Govt. Advocate (Crl.Side) on behalf of the Respondent the court made the following order:- (Made by P.N.PRAKASH, J.) On 23.08.
2021, this Court passed the following order: "This criminal miscellaneous petition has been preferred seeking to suspend the sentence imposed on the petitioner by judgment and order dated 25.02.2019 passed in Spl.S.C.No.
disposal of the appeal.

The petitioner, who was an accused in Spl.S.C.No.17 of 2017 before the Sessions Court, Magalir Neethimandram, (Fast Track Mahila Court), Tiruvallur, was convicted and sentenced as follows on 25.02.2019:

Provision under which convicted Sentence Section 5(m) r/w 6 of the Protection of Children from Sexual Offences Act, Life imprisonment and fine of Rs.10,000/-, in default to undergo six months rigorous imprisonment.
Section 506(I) IPC One year rigorous imprisonment.
The aforesaid sentences were ordered to run concurrently. 3.
Challenging the above conviction and sentences, the petitioner has filed Crl.A.No.384 of 2019 with the instant criminal miscellaneous petition seeking interim suspension of sentence and bail.

Heard Mr.R.Sasikumar, learned counsel for the petitioner and Mr.R.Muniyapparaj, learned Government Advocate (Crl.Side) appearing for the respondent/State.

Today, S.Tharaneswari, Inspector of Police, All Women Police Station, Uthukottai, Tiruvallur District, is present. 6.
It is seen that the petitioner's daughter viz., Lekha @ Dharani is getting married on 25.08.2021 and the same has been confirmed by the report of the Inspector of Police, All Women Police Station, Uthukottai, Tiruvallur District.

In such view of the matter, this Court is inclined to grant interim suspension of sentence and bail to the petitioner till 01.09.2021 on the following conditions:
(i) The petitioner shall execute a bond for a sum of Rs.25,000/-, with two sureties, of whom, one should be a blood relative, each for a like sum to the satisfaction of the Sessions Court, Magalir Neethimandram, (Fast Track Mahila Court), Tiruvallur; (ii) The sureties shall affix their photographs and Left Thumb Impression in the surety bond and the trial Court may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;
(iii) The petitioner shall report before the respondent/police on 28.08.2021 at 6.00 p.m.; and
(iv) The petitioner shall surrender before the trial Court on 02.09.2021 at 10.30 a.m., failing which, the respondent/police shall secure him, produce him before the trial Court and remand him in judicial custody. Post the matter on 03.09.2021, under the caption "for reporting compliance"."

Today, when the matter was taken up for hearing, the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) submitted that in compliance with the order dated 23.08.2021 in Crl.M.P.No.8193 of 2021 in Crl.A.No.384 of 2019, the petitioner was released on interim bail and he surrendered before the trial Court on 02.09.2021.
Recording the same, this criminal miscellaneous petition stands closed.
