(b) to adjudicate the Debtors and Insolvents; (c) to direct that the estate of the Debtors be vested in the Official Assignee of Madras, for the benefit of the general body of creditors of the Debtors;

(d) to order that the costs of this petition be paid by the Official Assignee of Madras, from and out of the estate of the Debtors to the petitioning Creditor; For Petitioner : Mr.T.Srikanth For Respondents : Set ex-parte 1/4

O R D E R

Learned counsel appearing for the petitioner would submit that the petitioner/creditor is not co-operating and he has no instructions from his client. In this regard, he has also sent notice to the petitioner/creditors, but, the notice returned with an endorsement "Door Locked".

2.Considering the submission made by the learned counsel appearing for the petitioner that even though he made number of attempts to contact his client, he could not able to contact him and since the matter is pending for the past two years, this Court is not inclined to keep the matter pending. Hence, this petition is dismissed. No costs.
