Respondent Prayer: Writ petition filed under Article 226 of the Constitution of India, praying for the issuance of Writ of Mandamus, directing the respondent to pass a comprehensive order to the claim of patta in respect of the lands comprised in S.No.310 and its subdivision situated now at Beemanthangal Village (formerly Nemili Village) in Sriperumbudur Taluk, Kanchipuram District after issuing notice to all persons for whom patta was granted.

O R D E R

This writ petition has been filed for the issue of a writ of mandamus directing the respondent to pass orders on the petition filed by the petitioner on 30.06.2020, within the time limit fixed by this Court.

2. Mr.E.Balamurugan, learned Special Government Pleader appearing on behalf of the respondent submitted that the respondent has fixed a date of enquiry on 03.11.2020 at 10.30 A.M. The learned Special Government Pleader further submitted that notices will be issued to all the interested parties and after affording opportunity to the petitioner and others, final orders will be passed within the time limited fixed by this Court.

Mr.V.K.Vijay Raghavan, learned counsel appearing on behalf of the petitioner submitted that the entire dispute pertains to S.No.310 situated at Beemanthangal Village, Kanchipuram District and the legality of the patta granted to some other persons pertaining to this property is now under question and the same has to be enquired by the respondent. The learned counsel submitted that the respondents should be directed to hear all the parties concerned and orders should be passed within the time fixed by this Court.

Taking into consideration the facts and circumstances of the case and also the fact that the respondent has called the parties for an enquiry on 03.11.2020 at 10.30 AM, there shall be a direction to the the respondent to proceed further with the enquiry by affording opportunity to the petitioner and also to the other interested parties and pass final orders strictly in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

5. This writ petition is disposed of with the above directions. Consequently, connected miscellaneous petition is also closed. No costs.
