This Writ Petition has been filed challenging the impugned order dated 30.04.2024 passed by the third respondent.

2. Heard the learned counsel for both sides and perused the materials available on record.

The learned counsel for the petitioner would submit that the petitioner's medical expenses of Rs.2,02,570/- were claimed before the third respondent, it was rejected on the ground that the petitioner has not taken treatment in a covered hospital and for non-compliance of G.O.No.204, Finance (Pensioner), dated 30.06.2022.

At this juncture, the learned Government Advocate appearing for the first and second respondents would submit that an identical issue had been decided by the learned Single Judge of this Court in W.P.(MD).No.13429 of 2013 etc. batch dated 28.05.2019, wherein the learned Single Judge has dealt with this issue and ultimately concluded in paragraph 80 regarding the instances and how the claimant should proceed. If there is any dispute regarding reimbursement, it is for the person to approach District Level Empowered Committee.

In view of the above, the present Writ Petition is disposed of with a direction to the petitioner to file an application before the District Level Empowered Committee within a period of one week from the date of receipt of a copy of this order. If such application is received from the petitioner, the 3/5

District Level Committee is directed to dispose of the same in accordance with law, within a period of four weeks thereafter. Consequently, the connected Miscellaneous Petition is closed. No costs. 10.07.2025 kv Index : Yes/No Speaking order /Non Speaking Order To
